Pursuant to Title 17, United States Code, Section 512(c)(3), a notification of claimed infringement related to any of the ERA Ben Porter Realtor Properties must be a written communication addressed to the designated agent as set forth above, and must include substantially all of the following:
A physical or electronic signature of the owner (or person authorized to act on behalf of the owner) of an exclusive right that is allegedly infringed;
Specific identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a list of each copyrighted work claimed to have been infringed;
Information related to the work(s) reasonably sufficient for ERA Ben Porter Realtor to promptly locate the work (e.g. title of work, location within the ERA Ben Porter Realtor Properties, etc.);
Information reasonably sufficient to permit ERA Ben Porter Realtor to directly contact the complaining party, such as a complete name and address, telephone number, and an e-mail address;
A statement that the complaining party has a good faith belief that use of the work(s) in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement requesting that ERA Ben Porter Realtor take a specific act with respect to the alleged infringement (e.g., removal, access restricted or disabled); and
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
TRADEMARK USAGE POLICY:
This Trademark Usage Policy will show you the proper use of ERA Ben Porter Realtor trademarks and logos.
USE THE CORRECT SYMBOL
When referencing ERA Ben Porter Realtor trademarks and registered trademarks, always include the proper notation after the name and logo. (® for Registered Trademarks and ™ for Trademarks) Failure to do so dilutes our trademark protection. In text it is only necessary to annotate the first instance of the trademark in a given document or piece. After the first instance you may drop the ® or ™ after the word. When using logos, always include the ® or ™ in every instance. Logos may only be used under license from ERA Ben Porter Realtor.
THIRD PARTY LICENSORS
Some ERA Ben Porter Realtor services include products or services used under license from third party licensors. You may not use any such third party trademark without express permission from the owner.
RESERVATION OF RIGHTS
ERA Ben Porter Realtor is the owner of all right, title, and interest in the ERA Ben Porter Realtor brand and logos. No person or entity may reproduce or use (or authorize the reproduction or use of) the ERA Ben Porter Realtor brands and logos in any manner other than expressly authorized by ERA Ben Porter Realtor. Unauthorized use of ERA Ben Porter Realtor brands and logos is strictly prohibited.
